Administrative Law: Case Law

Materials in support of Administrative Law

Finding Judicial Case Law

In researching Administrative Law, you will likely need to search case law at some point, and this is all the more likely after Loper Bright Enterprises v. Raimondo gave the courts a more active role in regulatory oversight. Unfortunately, the sort of Notes of Decisions we often rely on for statutes are not available for regulations, as they are more likely to change rapidly and so West and Lexis do not make that sort of editorial investment.

Regulations are narrowly applied by their very nature, so the most reliable way to find cases analyzing them is simply to go to cases citing them. This can be achieved by going to the "Citing References" section of the Regulation on Lexis or Westlaw, or by running a search for the citation in quotes.
